This is not new, and doesn't change anything. He was illegally in possession of a gun and thus had no legal ability to be there. None of his attorney's arguments matter - he was not a resident of the State, he was on public property and he was a minor illegally in possession of an assault rifle under State law. He had no right to self-defense just as someone who robs a liquor store can't claim self-defense in returning fire if fired upon by the store clerk.
