Crosby's (R) attorney gets chance to argue for dismissal of election charges

PHOENIX — Oral arguments will be held next month on whether one or both felony charges should be dismissed against Supervisor Tom Crosby related to Cochise County’s delayed 2022 General Election canvass, a Maricopa County judge announced Thursday.

Judge Geoffrey Fish scheduled the arguments hearing for May 2 and rescheduled Crosby’s trial setting date to May 8, if it is needed. There had been a possibility a jury trial would have started that week if Fish ruled against Crosby’s motion to dismiss during an April 10 case management hearing.

Crosby was indicted by a state grand jury in late 2023 in connection with votes he made that delayed canvassing the county’s 2022 General Election results past the statutory deadline.

One of the felony charges alleges conspiracy while the other alleges Crosby interfered with the election duties of then-Arizona Secretary of State Katie Hobbs. But a defense motion to dismiss argues that Cochise County’s delayed canvass did not prevent Hobbs from completing the statewide canvass on the day she had previously announced.
