Judge denies California's request for immediate restraining order but sets arguments for Thursday

A federal judge in San Francisco declined on Tuesday California’s request to immediately block the Trump administration from using Marines and members of the state’s National Guard to enforce laws in the state, including by assisting federal officials with immigration enforcement.

Senior US District Judge Charles R. Breyer instead scheduled a hearing for 1:30 p.m. Thursday over a request from the state for a temporary restraining order that would bar officials from directing the service members to assist with certain law enforcement activities.

Attorneys for the state had asked the judge earlier Tuesday to swiftly issue the order without receiving a response from the Trump administration. But the judge has asked both sides to submit more written arguments in the case ahead of the hearing later this week.

In a brief filing to the court Tuesday afternoon, the Justice Department called the state’s request “legally meritless” and argued that if granted, it “would jeopardize the safety of Department of Homeland Security personnel and interfere with the Federal Government’s ability to carry out operations.”

he will invoke the Insurrection Act. Even if the crowds were 100% peaceful he will send in undercover agitators in masks etc. to commit acts and then use those acts as his claim of "violent insurrection". I believe they will be planning to do this at the "No Kings" demonstrations as well.

This may all move very fast over the coming 7 days or so. The country may find itself on official military occupation, suspension of habeas corpus and more by the end of June.

A federal judge Tuesday declined California’s request to issue an emergency order to block President Donald Trump’s use of California National Guard troops and Marines within Los Angeles.

Judge Charles Breyer, the brother of former Supreme Court Justice Stephen Breyer who was appointed by former President Bill Clinton, instead said he will hold a hearing on California’s request Thursday before making a decision.

California Gov. Gavin Newsom (D) asked Breyer for an emergency order earlier Tuesday.

The request stemmed from the state’s lawsuit against Trump’s move to federalize the state’s National Guard without Newsom’s consent to counter largely peaceful protests in Los Angeles over recent aggressive immigration raids in the city.

eventually it would be used against our own people on our own soil. It didn't take a genius like me (not) to see this coming, to see we lost our democracy 25 years ago.
I recall Durbin making a strong, full throated denouement of the creation of Homeland and it's threat to our own citizens, calling out fascism which resulted in him getting threats of censure and forced to apologize to Bush. So sad to see him have to walk it back, because it was fucking truth.
