Last year, Hegseth threatened to court-martial Kelly after he participated in a video encouraging service members not to follow illegal orders. President Donald Trump responded to the video, suggesting Kelly's words were treasonous and could be punished by death.
Hegseth eventually backed down from the threat of a court-martial and said he would pursue a demotion instead. Kelly retired from the military with the rank of captain.
The lawsuit accuses Hegseth of violating the First Amendment, due process, the Speech & Debate Clause, and federal laws.
Kelly seeks judicial review over the process as well as "preliminarily and permanently enjoining Defendants, their agents, employees, appointees, successors, and anyone acting in concert or participation with Defendants from implementing, maintaining, or giving effect to Defendants' actions, including the Secretaryof Defense's determinations and threats of further criminal or administrative action."

(228 posts)A brief concise pleading that gets right to the point. If federal officials can move against people who speak out against them then the 1st Amendment means nothing.
Edit: Not quite as concise as OP's link indicated. The actual filing is 46 pages (still fairly short by federal standards).

Hegseth said last week that the Pentagon was taking steps to downgrade Kellys military retirement rank and pay because of his seditious statements a reference to a video he and other retired service members released that urged members of the military not to comply with illegal orders.
The suit charges Hegseth's actions violate Kelly's First Amendment rights, as well as the Speech and Debate clause of the Constitution, which grants immunity to lawmakers for official acts.
"It appears that never in our nations history has the Executive Branch imposed military sanctions on a Member of Congress for engaging in disfavored political speech," says the suit, which seeks a court order declaring Hegseth's actions to be unlawful.
Allowing Defendants to punish a Senator through military proceedings for his political speech erodes the separation of powers and gives the Executive a power over legislators that the Constitution does not contemplate, the filing says......
"And by that logic, a 100-year-old World War II veteran could be hauled in and censured or court-martialed because he says something that Pete Hegseth disagrees with," he added.
