How did they have to rule so freaking fast on this considering the original judge took too much time anyway in my opinion on his conclusion hours earlier tonight.

I didn't even get through 1 freaking beer in celebration of him taking back the control of the Cali National Guard ... and then pffff .... Fuck this bullshit. I don't care who's on the 9th circuit court and who appointed them ... they may as well be 'detached' from the reality on the ground here in Cali as the rest of DC. WTF ... you reap what you sew. (37,102 posts)It is the reason the trial court stayed its own order until noon tomorrow - to give the Appellate court a chance to extend the stay. Bouncing back and forth between Newsom controlling or Trump controlling the National Guard is generally worse than a quick temporary decision by the appellate court to keep things as they are now (Trump in control). The review of the injunction is on fast track - I believe the hearing is Thursday, after each side gets a chance to brief the matter.
Which is why it took the trial court "too much time." Courts work by each side getting to brief the matter - typically one after the other so that all of the nuances of the law are teased out in order to make the best decision - that means at least two (and generally 28 days minimum). This is a very rapid briefing schedule.

(37,102 posts)And the matters over which they have jurisdiction. Don't expect the courts to be something they are not. Each branch has its role to play, and it is not the fault of the courts that the other two branches are screwing up - and the fact that they are screwing up isn't reason to demand the courts screw up also.

(11,319 posts)The panel stayed Judge Breyer's order to June 17, when they will hold a hearing. That will be with a randomly selected panel of 11 with the Chief Judge of the Circuit presiding.
FWIW, the entire circuit is 29 members:
10 appointed by Trump
3 appointed by GWB
The rest Clinton, Obama, or Biden
So the odds of sanity ruling at this level is somewhat better than 50% 50%.
But the damage done by leaving the guard under orders of the 47 regime for another five days is enormous.
