SCOTUS reviews decisions of the lower court. In most instances it does not have original jurisdiction.

If Donald Trump declares martial law on Saturday - what does THAT do to this ruling? I think time is of the essence. I think he fully intends to declare martial law on Saturday. That's why all of the NG troops are in place in various areas, and why the tanks are in DC under the guise of having a freaking parade.
