Andrew Weissmann, former top prosecutor for the Justice Department and Tim Miller, Host of The Bulwark Podcast joins Nicolle Wallace on Deadline White House with reaction to the FBI carrying out the arrest of a Wisconsin federal judge outside of her courthouse alleging she was obstructing the arrest of an illegal alien, and how the motivation behind how the FBI carried this out is meant to send a chilling effect.

(4,721 posts)This is a breach of one branch of Govt. by another. That's definitely in violation of the Constitution.

They continually gave Trump a pass or slapped him on the wrist.
Now the vicious psychopath is terrorizing the world.

(35,830 posts)the arrest was the signal to intimidate other Judges.

(4,330 posts)That's to be commended, not punished by arresting him at the courthouse.
I'm sure that's what offended the judge's sense of fair play.
If ICE wants to arrest him, don't do it where he is complying with his legal obligation to appear.

(10,557 posts)Why is this being discussed like it's a normal case.
We are way over the edge on this.
Talking about this is normal terms is ridiculous.
Arresting judges, threatening to arrest journalists and sending innocent people to foreign torture prisons is pull all the levers , 5 alarm fire bad.

(70 posts)to shadow appellants , follow them in, then cart them off once satisfied that is the person they seek. The method is to intimidate, bully with false info and equipment, then sneak off to holding cells with their victims.
I cannot emphasize too strongly that resistance (as much as you can muster) at critical locations (courthouses, actual ICE centres) is absolutely needed at this point.
Youve had one civil war for freedom, if you dont want another (and with todays weaponry will be really ugly) act now while you outnumber the toy soldiers. An emboldened administration is recruiting an army of these fellows as we speak.
I dont want to tell you that its your life at stake, but your constitutional rights and freedoms are . Let the autocrats roll over you if you want, then regret you didnt stand up to a bully and bloody his nose.

(20,301 posts)is irrelevant. Everything this American Gestapo is doing is about intimidation and cruelty.
And they better watch themselves. Nabbing people off the street while masked, in a country awash in a sea of firearms, is going to get some of them shot and killed. And I will not shed one goddamn tear for them. They got what they deserved.

(1,542 posts)This criminal complaint seems pretty thin on the statutes charged. She allowed the defendant to leave the courtroom by a different door in her courtroom. The arresting agents literally saw him in the hallway right after going to elevator 1/
That hardly seems like concealment, and whether she obstructed would have to establish that she had corrupt intent in letting him exit out of a different door. Which, unless it was unlawful for her to do that, is her prerogative in her courtroom 2/
I think what a judge does within her lawful power within the four corners of her courtroom would be given great deference, and to inquire into motives would raise judicial immunity questions (the same way inquiring into POTUS motives for official acts raise immunity questions) 3/
This also raises Tenth Amendment concerns. Of course federal law applies to state officials, but can they be compelled (commandeered) to go above and beyond and facilitate (😏

I find it surprising that this would meet the Justice Manuals standards for prosecution. Seems more like an attempt to intimidate state judges into caving into federal encroachment into their duties
And another BlueSky poster on that thread
ICE HAD an ADMINISTRATIVE WARRANT
the 4th STATES ONLY JUDICIAL WARRANTS
are Constitutional
Expressio unius est exclusio alterius"meaning "the expression of one thing is the exclusion of another.
excluded are legislative or executive warrants
ICE ACTED UNCONSTITUTIONALLY

(113,267 posts)because rright now it could be anything from muscling an ICE agent down a stairwell to backing out of her assigned parking space and preventing one from running down a small brown child.
It's got to go through due process, even if the arrest was handled in the most insulting manner. That's on the DOJ. We are going to have to wait a while to find out what exactly she is alleged to have done.
